Who Issues Form 1098-F

Federal, state, local, or other government authorities (or entities treated as governmental) that impose fines, penalties, or other amounts on individuals or organizations as part of an investigation or enforcement action. The form is issued when the total amount involved exceeds $50,000.

Who Receives Form 1098-F

Taxpayers or Entities Subject to Fines: Any individual or entity that is subject to a fine, penalty, or other amounts related to violations of law, and if the total exceeds $50,000, will receive Form 1098-F from the governmental entity.

Purpose of Form 1098-F

The form is used to report fines, penalties, and certain other amounts imposed for the violation of any law. It is also used to differentiate between non-deductible fines and penalties and amounts that might be deductible if they qualify as restitution or are paid to come into compliance with the law.

Due Date

January 31 is the due date for furnishing Form 1098-F to the individual or entity that paid the fine or penalty. File electronically with the IRS by March 31.
